NORVELL AND MARGARET NORVELL, AS TENANTS BY THE ENTIRETY as grantor, to LAND AMERICA LAWYERS TITLE as trustee, in favor of WELLS FARGO FINANCIAL OREGON, INC., as beneficiary, dated 07/26/2007 recorded on 08/17/2007, in the Records of MARION County, OR, in book 2854 at page 381 and/or as fee/file/instrument/microfilm/reception No. 203484, covering the following described real property situated in the above-mentioned county and state, to wit: APN: R65888 SEE LEGAL DESCRIPTION EXHIBIT A Exhibit A Legal Description LOT 107 AND THE NORTHERLY 10 FEET OF LOT 108, BATTLECREEK COMMONS PHASE III, SALEM MARION COUNTY, OREGON MARION COUNTY Commonly Known As: 6514 HUNTINGTON CR SE, SALEM, OR 97306 Both the beneficiary HMC Assets, LLC solely in its capacity as separate trustee of CAM XI TRUST and the trustee First American Title Insurance Co have elected to sell the said real property to satisfy the obligations secured by said trust deed and a Notice of Default has been recorded pursuant to ORS 86.752(3). Therefore, notice hereby is given that undefined the undersigned trustee will on 07/29/2022 at the hour of 10:00AM, Standard of Time, On the outside steps of the main entrance to the Marion County Courthouse, 100 High St NE, Salem, OR 97301 as established by ORS187.110, in the County of MARION, State of OR, sell at public auction to the highest bidder for cash the interest in the said described real property which the grantor had or had power to convey at the time of the execution by grantor of the said trust deed, together with any interest which the grantor or his successors in interest acquired after the execution of said trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five (5) days before the date last set for sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying the sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee’s and attorney fees not exceeding the amounts provided by ORS 86.778. In construing this notice the masculine gender includes the feminine and the neuter, the singular includes the plural the word grantor includes any successor in interest to this grantor as well as any other person owing an obligation, the performance of which is secured by the trust deed, and the words trustee and beneficiary include their respective successors in interest, if any. Pursuant to Oregon Law, this sale will not be deemed final until the Trustee’s Deed Upon Sale has been issued by the Trustee. If any irregularities are discovered within 10 days of the date of this sale, the Trustee will rescind the sale, return the buyer’s money and take further action as necessary. If the sale is set aside for any reason, including if the Trustee is unable to convey title, the Purchaser at the sale shall be entitled only to a return of the monies paid to the Trustee.
