CITY OF HUBBARD PUBLIC NOTICE OF BALLOT TITLE Notice is hereby given that the City Council of Hubbard, Oregon has referred a Measure to the November 8, 2022, ballot. The following Ballot Title prepared by the City of Hubbard city attorney was filed with the City Recorder who serves as the City elections official on August 10, 2022: Caption: Prohibits psilocybin businesses within Hubbard. Prohibition sunsets after two years. Question: Shall the City of Hubbard declare a temporary ban prohibiting psilocybin-related businesses and manufacture of psilocybin products within Hubbard? Summary: State law allows for the manufacturing, transportation, delivery, sale, and purchase of psilocybin, the psychedelic drug found in certain mushrooms. State law provides that a local government may adopt an ordinance to be referred to the voters to prohibit the establishment of licensed psilocybin product manufacturers and/or psilocybin service centers. The Hubbard City Council adopted an ordinance prohibiting the establishment of psilocybin product manufacturers and psilocybin service center operators within the City for a period of two years, which was referred to the voters per state law. The two-year prohibition is intended to provide additional time for the City to enact reasonable time, place, and manner restrictions on licensed facilities. Approval of this measure would prohibit the establishment of psilocybin product manufacturers and psilocybin service center operators within Hubbard city limits until December 31, 2024. NOTICE is also hereby given that any elector in the City of Hubbard may petition the Marion County Circuit Court to review the ballot title. The deadline to file a petition to review the ballot title is no later than the 7th business day after the ballot title is filed with the elections official; therefore, the deadline is 5:00 p.m. on August 19, 2022. The Elections Official/City Recorder must be notified within one day of any petition being filed in the circuit court challenging the ballot title.
