TRUSTEE’S NOTICE OF SALE There is a default by the grantors, or other persons that owe an obligation, in the obligations secured by the trust deed described in this notice. The beneficiary and trustee, by reason of the default, have elected to foreclose the trust deed by advertisement and sale pursuant to ORS 86.705 through ORS 86.815, and to cause to be sold at public auction to the highest bidder for cash the interest in the described property which grantors had, or had the power to convey, at the time of execution by grantors of the trust deed, together with any interest grantors or grantors’ successors in interest acquired after the execution of the trust deed, to satisfy the obligations secured by the trust deed and the expenses of sale, including the compensations of the trustee as provided by law, and the reasonable fees of the trustee’s attorneys. The undersigned certifies that no assignments of the trust deed by the trustee or by the beneficiary and no appointments of successor trustee have been made, except as recorded in the records of the county in which the real property described in this notice is situated. Further, no action has been commenced to recover any part of the debt or any part of the debt then remaining secured by the trust deed, or, if an action has been commenced, then the action has been dismissed. The following information is given, pursuant to ORS 86.752 and ORS 86.771: 1. No. 2020-009198 in Washington County Deeds and Records in Washington County, Oregon. 2. PROPERTY: The address of the property covered by the trust deed is more particularly described as follows: PARCEL 1, PARTITION PLAT NO. 2004-029, IN THE CITY OF SHERWOOD, COUNTY OF WASHINGTON AND STATE OF OREGON. 3. DESCRIPTION OF THE TRUST DEED SUBJECT OF THIS NOTICE: Made on January 21, 2020, and dated January 21, 2020, recorded January 22, 2020, as Document Number 2020-006043 in Washington County Deeds and Records in Washington County, Oregon; and Assignment of Trust Deed by Beneficiary dated February 3, 2020, and recorded on February 3, 2020, as Document Number 2020-009198 in Washington County Deeds and Records in Washington County, Oregon. 4. DEFAULT: The default for which foreclosure is made is: A. Failure to pay when due the sum of $6,113,472.14 in principal and interest falling due at the maturity on February 1, 2022, per the Promissory Note dated January 21, 2020. B. Failure to pay when due the sum of $613,022.08 for late charges, unpaid charges accrued through June 3, 2022, including interest at the rate of 16.99% per annum per the Promissory Note dated January 21, 2020, with interest continuing to accrue at a daily rate of $2,944.80 from April 5, 2022. 5. BALANCE OWING ON THE OBLIGATION THAT THE TRUST DEED SECURES: All sums owing pursuant to the Promissory Note dated January 21, 2020, as secured by the Trust Deed dated January 21, 2020, recorded January 22, 2020, as Document Number 2020-006043 in Washington County Deeds and Records in Washington County, Oregon, as assigned via Assignment of Trust Deed by Beneficiary dated February 3, 2020, and recorded on February 3, 2020, as Document Number 2020-009198 in Washington County Deeds & Records in Washington County, Oregon, in the principal amount of $5,682,000, plus interest, late fees, including interest at the rate of 16.99% per annum, late fees, and taxes, as set forth in paragraphs 4A and 4B hereinabove. Beneficiary is also entitled to Trustee’s fees, attorney’s fees, foreclosure costs, and any sums advanced by the Beneficiary pursuant to the terms of the Trust Deed and Note. 6. The property will be sold to satisfy the obligation in paragraph 5, above. 7. SALE: The property will be sold in the manner prescribed by law on Thursday, October 13, 2022, at 10:00 a.m., in accordance with the standard of time established by ORS 187.110, on the steps of the 2nd Avenue entrance of Washington County Courthouse, 145 N.E. 2nd Avenue, Hillsboro, Washington County, Oregon. 8. RIGHT TO CURE DEFAULT UNDER ORS 86.778: Any person named in ORS 86.778 has the right, at any time that is not later than five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by paying the entire amount then due (other than the portion of the principal that would not be due had no default occurred) together with costs and expenses actually incurred in enforcing the obligations, including trustee’s and attorney’s fees (not exceeding the amounts provided by ORS 86.778) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the note and trust deed. WARNING RE: THE POTENTIAL USE OF THE PROPERTY IN MANUFACTURING METHAMPHETAMINES: Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic.
