Tax ID Nos. 8781, 13053 and 8867 *A Memorandum of Modification of the Trust Deed was recorded on July 29, 2011 as Recording No. 2011-2319, and a Modification of Line of Credit Deed of Trust and Fixture Filing was recorded on August 30, 2016 as Recording No. 2016-3055, both in the Records of Jefferson County, Oregon. The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which foreclosure is made is Grantor’s failure to pay when due at maturity on January 15, 2022 due according to the terms of the promissory note, secured by the Trust Deed described above, namely: $233,890.00 Principal and interest due 5/6/2022 $250.00 2019 Extension Fee $265.50 Attorney Fees $1,350.00 Foreclosure Guarantee <$93,408.54> Less post maturity payments per Forbearance Agreement $142,331.96 TOTAL PAST DUE as of May 6, 2022 * There is also a default by the Grantor or other person owing the obligations, the performance of which is secured by a First Deed of Trust to Northwest Farm Credit Services, FLCA recorded in Jefferson County Records on August 31, 2006 as Recording No. 2006-005355 (First Deed of Trust). This is a foreclosure of a Second Deed of Trust only (described in the first paragraph above). In order to cure the default on this Trust Deed, the First Deed of Trust must also be brought current. Additionally, a Trustee’s foreclosure sale relating to the First Deed of Trust is scheduled for November 1, 2022 at 11:15 o’clock a.m. Pacific Time on the front steps of the Jefferson County Courthouse, 129 SW E St, Madras, Oregon. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. Notice is hereby given that the undersigned will on Tuesday, November 1, 2022, at 11:00 o’clock a.m., Pacific Time, on the front steps of the Jefferson County Courthouse, 129 SW E St., Madras, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. In addition, stock in the amount of $1,000 must be repurchased in Northwest Farm Credit Services, ACA pursuant to 12 USC 2034 as a condition of cure and reinstatement.
