KASTLER, Grantors, to WEST COAST TRUST, as Trustee, in favor of COLUMBIA STATE BANK, SUCCESSOR BY MERGER TO WEST COAST BANK, as Beneficiary, dated September 22, 2008, recorded October 2, 2008, as Document No. Reel 2998, Page 429, Official Records of Marion County, Oregon, covering the following described real property situated in Marion County, Oregon, to-wit: Beginning at the Northwest corner of a tract of land described in Volume 392, Page 50, Marion County Deed Records; thence South 0deg.50′ West along the West line of said tract, 194.00 feet; thence East parallel with the North line of said tract 128.0 feet; thence North 0deg.50′ East parallel with the West line of said tract 194.00 feet to the North line of said tract; thence West along the North line of said tract 128.00 feet to the place of beginning. For value received, Beneficiary granted, assigned, transferred, and set over all remaining beneficial interest in and under the Deed of Trust, together with the notes, moneys, and obligations therein described or referred to, with the interest thereon, and all rights and benefits whatsoever accrued or to accrue under the Deed of Trust, as is, without warranty or representation of any kind, to Creative Real Estate Solutions, LLC, an Oregon limited liability company (Successor Beneficiary), by an Assignment of Note and Trust Deed dated August 8, 2019, recorded September 16, 2019, as Document No. 2019-00043796 in the Official Records of Marion County, Oregon. Successor Beneficiary appointed Alan N. Stewart (Current Trustee) of Merrill O’Sullivan, LLP, 805 SW Industrial Way, Suite 5, Bend OR 97702, as Successor Trustee by an Appointment of Successor Trustee, dated September 27, 2019, recorded September 27, 2019, as Document No. 2019-00046162 in the Official Records of Marion County, Oregon. For value received, Successor Beneficiary granted, assigned, transferred, and set over all remaining beneficial interest in and under the Deed of Trust, together with the notes, moneys, and obligations therein described or referred to, with the interest thereon, and all rights and benefits whatsoever accrued or to accrue under the Deed of Trust, as is, without warranty or representation of any kind, to CRES Investments LLC, an Oregon limited liability company (Current Beneficiary), by an Assignment of Note and Trust Deed dated December 11, 2020, recorded December 15, 2020, as Document No. 2020-00069386 in the Official Records of Marion County, Oregon. Both the Current Beneficiary and Current Trustee have elected to sell the said real property to satisfy the obligations secured by said Deed of Trust and a Notice of Default has been recorded pursuant to Oregon Revised Statutes 86.752(3). By reason of the default, the Current Beneficiary has declared all sums owing on the obligation secured by the Deed of Trust immediately due and payable, those sums being the following, to-wit: As of February 19, 2020, unpaid principal, property taxes, attorney’s fees, foreclosure costs, sums advanced by the beneficiary pursuant to the terms of said Deed of Trust, and accrued interest in the amount of $109,500.00 plus any unpaid property taxes, attorney’s fees, foreclosure costs, sums advanced by the beneficiary pursuant to the terms of said Deed of Trust, and interest continuing to accrue. WHEREFORE, notice is hereby given that the undersigned Current Trustee will on February 1, 2023, at the hour of 11:00 o’clock, A.M., in accord with the standard of time established by ORS 187.110, at the following place: on the front steps of the Marion County Courthouse, located at 100 High Street NE, in the City of Salem, County of Marion, State of Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors have or had power to convey at the time of the execution by Grantors of the said Deed of Trust, together with any interest which the obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the Current Trustee. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five (5) days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Deed of Trust reinstated by payment to the Current Beneficiary of the entire amount then due (other than such portion of the principal and interest as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or Deed of Trust, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Deed of Trust, together with Current Trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.778. In accordance with the Fair Debt Collection Practices Act, this is an attempt to collect a debt, and any information obtained will be used for that purpose. This communication is from a debt collector. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale. In construing this Notice, the singular includes the plural, the word Grantor includes any successor in interest to the Grantor as well as any other person owing an obligation, the performance of which is secured by said Deed of Trust, and the words Trustee and Beneficiary include its respective successors in interest, if any.
