KATE HOLLAND-STONE, an individual; JOSHUA JAMEEL STRICKLAND, an individual, JAMES C. STRICKLAND, an individual; EMILY ANN STRICKLAND, an individual; STEVEN O. STRICKLAND, an individual; DIANE ELIZABETH SELLA, an individual; THE UNKNOWN HEIRS, ASSIGNS, AND DEVISEES OF MICHAEL STRICKLAND; and PARTIES IN POSSESSION OR CLAIMING A RIGHT TO POSSESSION, Defendants. TO: ANY REPRESENTATIVE OF THE ESTATE OF MICHAEL STRICKLAND, OR ANY REPRESENTATIVE OF THE UNKNOWN HEIRS, ASSIGNS, AND DEVISEES OF MICHAEL STRICKLAND, of the above-named defendants. You are hereby required to appear and defend the complaint filed against you in the above-entitled action, within thirty (30) days from the date of the first publication of this summons, and in case of your failure to appear and answer, plaintiff for want thereof will apply to the above-entitled court for the relief prayed for in its complaint. SUMMARY STATEMENT: This action relates to Plaintiff’s desire to foreclose its claim against the real estate described as: Unit 22, ASCOT PARK CONDOMINIUM, in the City of Portland, County of Multnomah and State of Oregon, TOGETHER WITH an undivided interest in and to the general and limited common elements appertaining to said unit, as set forth in Declaration of Unit Ownership recorded October 2, 1979, in Book 1387, Page 1409, as amended by instrument recorded July 26, 1991, in Book 2439, Page 1002, Deed Records. WHEREFORE, Plaintiff prays for the following relief: (1) For a general judgment against Defendants in the amount of $6,316.71, plus all monthly assessments, reserve assessments, serial monthly special assessments, late fees, fines, interest, and other charges that have accumulated after September 8, 2022, to date of the sheriff’s sale, plus interest at the rate of 9.0% per annum from the date of judgment until paid, and for its attorney’s fees in an amount to be determined by the court, plus its incurred costs and disbursements; (2) For a general judgment foreclosing its claim of lien against the real property described in paragraph 2 of this complaint; declaring that the Association’s lien be declared to be a first, valid, and subsisting lien against the property superior to any interest of the defendants; and declaring that the property be sold by the Sheriff of Multnomah County, in a manner provided by law, as on execution, to satisfy the amounts owing; and declaring that the Association be permitted to purchase at the sale; and (3) For such other and further relief as the court deems just and equitable; (4) Or, in the alternative, for a money judgment against the Owner Defendants in the amount of $6,316.71, plus all assessments, late fees, interest, and other charges due hereunder which have accumulated after September 8, 2022, to date of judgment, plus interest thereon at the rate of 9.0% per annum from the date of judgment until paid, and for reasonable attorney fees and disbursements incurred herein.
