TRUSTEE’S NOTICE OF SALE The Trustee under the terms of the Trust Deed described herein, at the direction of the Beneficiary, hereby elects to sell the property described in the Trust Deed to satisfy the obligations secured thereby. Pursuant to ORS 86.771, the following information is provided: 1. PARTIES: Grantor: FRANCES K. SWANSON Trustee: BRAD WILLIAMS C/O UPF WASHINGTON INCORPORATED Successor Trustee: NANCY K. CARY Beneficiary: UMPQUA BANK 2. DESCRIPTION OF PROPERTY: The real property is described as follows: A tract of land in the J.D. Garrett Donation Land Claim in Section 31, Township 1 South, Range 2 East of the Willamette Meridian, in the City of Milwaukie, County of Clackamas and State of Oregon, described as follows: Beginning at the Northeast corner of said Donation Land Claim; thence Westerly along the North line of said claim 387.12 feet to the true point of beginning; thence Westerly along the North line of said claim 100.00 feet to the Northeast corner of that tract of land conveyed to Elton L. Kemnitz, et ux, recorded January 17, 1967, in Book 684, Page 578, Clackamas County Deed Records; thence Southerly along the East line of said Kemnitz Tract 158.10 feet to the Southeast corner thereof and the North line of that tract of land conveyed to Carl J. Hendrickson et ux, recorded May 14, 1948, in Book 406, Page 393, Clackamas County Deed Records; thence Easterly along the North line of the Hendrickson tract 100.00 feet to the West line of Wichita Avenue; thence Northerly along the road line and the Northerly extension thereof 158.1 feet to the true point of beginning. EXCEPTING THEREFROM the Southerly 70 feet as cut off by a line drawn parallel with the South line thereof. 3. RECORDING. The Trust Deed was recorded as follows: Date Recorded: April 23, 2019 Recording No. 2019-021518 Official Records of Clackamas County, Oregon 4. DEFAULT. The Grantor or any other person obligated on the Trust Deed and Promissory Note secured thereby is in default and the Beneficiary seeks to foreclose the Trust Deed for failure to pay: Monthly payments as follows: December 26, 2021: $755.57 January 26, 2022: $780.72 February 26, 2022: $780.72 March 26, 2022: $705.17 April 26, 2022: $782.40 May 26, 2022: $880.90 June 26, 2022: $836.13 July 26, 2022: $911.63 plus late charges and advances; plus any unpaid real property taxes or liens, plus interest. 5. AMOUNT DUE. The amount due on the Note which is secured by the Trust Deed referred to herein is: Principal balance in the amount of $245,130.69; plus interest at the rate of 6.00% per annum from November 26, 2021; plus late charges of $234.29; plus advances and foreclosure attorney fees and costs. 6. SALE OF PROPERTY. The Trustee hereby states that the property will be sold to satisfy the obligations secured by the Trust Deed. A Trustee’s Notice of Default and Election to Sell Under Terms of Trust Deed has been recorded in the Official Records of Clackamas County, Oregon. 7. TIME OF SALE. Date: January 5, 2023 Time: 11:00 a.m. Place: Clackamas County Courthouse, Front Entrance, 807 Main Street, Oregon City, Oregon 97045 8. RIGHT TO REINSTATE. Any person named in ORS 86.778 has the right, at any time that is not later than five days before the Trustee conducts the sale, to have this foreclosure dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due, other than such portion of the principal as would not then be due had no default occurred, by curing any other default that is capable of being cured by tendering the performance required under the obligation or Trust Deed and by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with the trustee’s and attorney’s fees not exceeding the amount provided in ORS 86.778. ___________________________________________________________ NOTICE REGARDING POTENTIAL HAZARDS (This notice is required for notices of sale sent on or after January 1, 2015.)
