CITY OF HILLSBORO NOTICE OF PUBLIC HEARING CASE FILE NOS. AN-006-22 & ZC-007-22 NE MEEK & 30TH NOTICE IS HEREBY GIVEN that two public hearings will be held before the City Council at or shortly after 7:00 pm, at their regular meeting on Tuesday, November 15, 2022. This meeting will be held in person in Conference Room 113, located on the 1st floor at the Civic Center, 150 E Main Street, Hillsboro, AND remotely via Zoom. Instructions on how to join the Zoom virtual meeting are listed below. At this hearing, the City Council will consider a request for the annexation (Case File No. AN-006-22) of four properties approximately 139.02 acres in size into the City limits of Hillsboro to facilitate future development of the property. Annexation of the property would also include its withdrawal from the Tualatin Valley Fire and Rescue Service District and annexation to the Clean Water Service District. In addition, a City-initiated Zone Change (Case File No. ZC-007-22) on the subject property will apply the City’s I-S Industrial Sanctuary zone and associated Regulatory Floodplain Overlay (RFO) and Significant Natural Resource Overlay (SNRO) upon annexation. The subject property can be specifically identified as Tax Lot 800 on Washington County Assessor’s Tax Map 1N2-16 and Tax Lots 1504, 1600, and 1602 on Washington County Assessor’s Tax Map 1N2-21 and is generally located north of NE Huffman Street, south of NW Meek Road, east of NE Sewell Avenue, and west of NE Starr Boulevard. The property owner is Robbie Hammond, Hillsboro Economic Development Council and the applicant is Justin DeMello, Hillsboro Economic Development Council. The applicable criteria for an Annexation are listed in Metro Code Chapters 3.09.045 and 3.09.050 and Section 12.80.010 of the Community Development Code (CDC). The applicable criteria for a Zone Change are listed in CDC Section 12.80.168. The CDC may be viewed online at www.hillsboro-oregon.gov/communitydevelopmentcode or in the Planning Division office. All interested persons are invited to attend this hearing in person or virtually on Zoom (instructions below) and will be given an opportunity to be heard concerning the proposal. Testimony can be submitted in writing prior to the meeting or provided during the hearing. Instructions are provided below on how to provide that testimony. You will need to provide your name, phone number, and address when providing testimony so that the City can provide you with the necessary documents following the hearing. Written Testimony: If you would like to submit written testimony prior to the hearing, please send your testimony via email to council@hillsboro-oregon.gov. Testimony received after 8:00 am on the day of the hearing will be forwarded to the City Council either before or during the meeting. Please note that the City Council may have limited time to review any written testimony received after 8:00 am on the day of the public hearing. Please reference the case file no. on all written testimony. In-Person Testimony: You may testify in-person. At the hearing, the Mayor will call for public testimony, at which time you may request to speak. You will have three minutes once called upon. Please use the sign in sheet at the back of the room to sign in to receive a copy of the notice of decision. Teleconference Testimony: You may pre-register to speak during the hearing by providing your name, phone number, address, and Zoom account name to via email at council@hill sboro-oregon.gov prior to 5:00 pm on the day of the hearing. Your information will not be shared at the hearing. At the hearing, the Mayor may read down the list of those who pre-registered. If you were unable to pre-register prior to the meeting, you may email council@hillsboro-oregon.gov during the hearing to request to speak or use the raise hand function in Zoom. You will have three minutes to speak once called upon. Members of the public using Zoom will not be able to share their screen during the meeting; presentation materials should be submitted as written testimony by 5:00 pm on the day of the hearing to council@hillsboro-oregon.gov. Testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. Oregon Revised Statutes (ORS) 197.797 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. Telephone conversations cannot be accepted as testimony. General comments, requests and inquiries, not related to the hearing, can be emailed to planning@hillsboro-oregon.gov. Pursuant to ORS 197.797, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
