NOTICE OF PUBLIC HEARING The Happy Valley Planning Commission will hold a hybrid in-person/virtual public hearing via ZOOM and at City Hall, on Tuesday, December 13, 2022 at 6:00 p.m. regarding the below matter: LDC-05-22: Happy Valley Municipal Code (Land Development Code) Amendments for Psilocybin. In November of 2020, Ballot Measure 109, the Oregon Psilocybin Services Act was passed by voters in Oregon which created a license and regulatory framework for production of psilocybin and facilitation of psilocybin services for adults 21 years of age and older. The proposed citywide Land Development Code amendments include local time, place, and manner land use regulations which apply to psilocybin activities. The City may approve, approve with conditions or deny the citywide Legislative application at a public hearing in accordance with the applicable Statewide Planning Goals; applicable sections of Oregon Administrative Rule (OAR) Chapter 660; applicable sections of Metro Code; applicable City of Happy Valley Comprehensive Plan Policies; and applicable sections of the City of Happy Valley Municipal Code Title 16 – Land Development Code (LDC), including but not limited to 16.61 (Types of Review Procedures); and 16.67 (Comprehensive Plan Map, Specific Area Plans, Land Use District Map and Text Amendments). Interested parties are invited to attend the hearing or to submit comments. Comments may be emailed to lterway@happyvalleyor.gov or mailed to the Planning Division at City Hall (16000 SE Misty Drive, Happy Valley, Oregon 97086). All written comments must be received by the City of Happy Valley by 5:00 p.m. on Monday, November 28, 2022 to be included in the Planning Commission packet which is available one week in advance of the hearing at https://www.hap pyvalleyor.gov/city-hall/agendas-minutes-packets/. The Zoom information is posted in the Planning Commission packet. All other written comments must be received prior to 5:00 p.m. the date of the hearing or verbal and/or written testimony may be entered into the record at the public hearing. Those wishing to present verbal testimony, as either proponents, opponents or to provide neutral testimony, will be asked to speak after presentation of the staff report. Testimony should pertain to the applicable criteria. The proposal will be reviewed at a series of public hearings including the Planning Commission followed by the City Council who is the final local review authority and will consider the proposal and an associated Ordinance at a subsequent public hearing. The hearings will be held per Title 16 of the Happy Valley Municipal Code and rules of procedure adopted by the Council and available at City Hall.
