IN THE SUPERIOR COURT OF THE STATE OF WASHINGTON IN AND FOR THE COUNTY OF KLICKITAT No. 22-2-00018-20 EX PARTE ORDER OF DEFAULT AND DEFAULT JUDGMENT SANDERS, SARAH, Petitioner, vs. GARCIA, SALVADOR; GARICA, ALICIA; and BUEHLER, ALICIA MARIE, Respondents. THIS MATTER came before the Court on Petitioner, Sarah Sanders by and through their Attorney’s, Benjamin J. Riley and Saxton Riley and Riley, PLLC’s motion for an order of default and default judgement against Respondents Salvador Garcia and Alicia Garcia, aka Alicia Marie Beuhler (Respondents). The motion was based on the ground that Respondents have not appeared, answered or otherwise defended in this action, it appearing that service by publication was made upon the Respondents as required by law; that the time for answering by or on behalf of each Respondent has expires; and the Court having heard the testimony and considered the evidence The Court being apprised in the premises and having reviewed the pleadings filed in the action and the records and files herein, which was brought to the Court’s attention. Based on the evidence presented hereto, the Court finds: 1. Petitioner and Respondents are tenants in common for property with the Klickitat County Parcel Number 06-19-2300-0070 and 06-19-2300-0080 (the Property). 2. The Property was purchased on a real estate contract for $62,500.00 on or about March 25, 2013. 3. Petitioner has, to date, made all of the payments on this real estate contract. 4. Petitioner has paid all property taxes, due and owing on the Property, since the date of purchase of the Property by Petitioner and Respondents. 5. Respondents were served by Publication. 6. Respondents have not appeared or answered in this matter. 7. Petitioner has provided maintenance and upkeep of the Property. NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that Respondents are in default for failing to appear or defend in this action. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Petitioner and Respondents are co-tenants and own the Property has that the fee simple title in and to lands and premises in Klickitat County, Washington, described as: SEE EXHIBIT A: KLICKITAT-LGL ATTACHED HERETO AND INCORPORATED HEREIN BY REFERENCE: be and the same is hereby quieted, established, and confirmed in the name of Petitioner Sarah Sanders. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that each and all of the Respondents, and the unknown heirs at law of the Respondents, and all other persons or parties unknown, claiming any right, title, estate, lien, or interest in or to said real estate or any portion thereof, and all persons claiming under the Respondents, or any of them, subsequent to the filing of the notice of the pendency of this action on January 20, 2022, be and they are hereby forever barred from having or asserting any right, title, estate, lien, or interest in the Property, or any part thereof, adverse to Petitioners. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that the Petitioner be allowed to enter an order to the court for the appointment of a trustee for such absent or nonresident respondent, to make or cancel any deed or conveyance of whatsoever nature, or do any other act to carry into effect the judgment or the decree of this court.
