The purpose of this notice is to invite comments for an application requesting approval of a Minor Modification to a Condition of Approval for the Brynhill Master Plan Refinement and Phases 2 Subdivision Review Brynhill 2 and Brynhill 3 (Case File No’s.: 20-046 and 20-047). Request: The Applicant is requesting approval of a Type II Minor Modification to modify the condition of approval regarding timing of the issuance of building permits in Brynhill Phase 3 in relation to the installation of a northbound left-turn lane at NW North Avenue and NW Glencoe Rd./NW Shadybrook Rd. WHAT IS THE DECISION PROCESS? After the comment period closes, the city will hold a public hearing with the Planning Commission. The Planning Commission’s decision may be appealed to the North Plains City Council by anyone who provides written testimony during the public comment period. The decision will be mailed to the applicant and anyone who submitted written comments or who is otherwise legally entitled to the notice of decision. HOW CAN I REVIEW THE DOCUMENTS AND STAFF REPORT? You can review application and staff report materials at City Hall. Copies are available at a reasonable price or can be emailed. The City will rely upon the materials to make the land use decision. INFORMATION TO INCLUDE IN COMMENTS: Issues which may provide the basis for an appeal to the Land Use Board of Appeals shall be raised in writing prior to the expiration of the comment period. Issues shall be raised with sufficient specificity to enable the decision maker to respond to the issue. Failure of an issue to be raised in a hearing, in person, or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue, precludes appeal. PUBLIC HEARING PROCESS: The public hearing will be conducted according to the process identified in Development Code Section 16.170. The application and all evidence relied upon by the City to make this decision is in the public record and is available for inspection at North Plains City Hall during regular business hours for no cost. Copies can be provided at a reasonable cost. The City’s staff report and recommendation to the Planning Commission will be available for review at no cost at City Hall or www.northplains.org no later than one week prior to the Planning Commission hearing. Failure to raise an issue in sufficient detail during the comment period or at the public hearing may preclude an appeal to the Land Use Board of Appeals or Appeals/Circuit Court on that issue. Only comments on the applicable criteria are considered relevant evidence. The hearing will be opened for presentation by the city and the applicant and then opened to the public. The hearing can be closed or continued at the discretion of the Planning Commission. If the hearing is closed, the Commission has the right to extend the time for additional information to be submitted by the public or the applicant. After the comment period closes on the final public hearing, the City shall issue a decision.
