Pursuant to Section 50.45.4 and 50.45.6.A of the Beaverton Development Code, public notice of the following development application is being provided: FLOOR & DCOR EASEMENT VACATIONS (SV2023-0001 / SV2023-0002) The applicant, Floor & Decor Outlets of America, Inc., requests approval to vacate two City of Beaverton bicycle/pedestrian easements. Both easements are in the southwest portion of the subject site. The applicant requests to vacate these easements because they conflict with the location of a proposed new Floor & Decor retail building and associated site improvements, which are being reviewed under a separate application. The site is located at 10700 SW Allen Boulevard on the south side of SW Allen Boulevard and east of Highway 217, specifically identified as Tax Lots 100, 200, 400, and 500 on Washington County Tax Assessor’s Map 1S122AA. The site is zoned Community Service (CS) and it is located within the boundaries of the Denny Whitford / Raleigh West Neighborhood Association Committee. Any decision on the above development proposal shall be based on the approval criteria contained in the following sections of the Beaverton Development Code: Sections 40.03.2 Facilities Review Committee and 40.75.15.1.C Street Vacation. The Facilities Review Committee Meeting with the applicant will be held on February 22, 2023. The Facilities Review Committee is not a decision making body but advises the Director and City Council on a project’s conformity to the technical criteria specified in Section 40.03.2 of the Beaverton Development Code. The Director will include the Committee’s recommendation in the staff report to the decision-making authority. The Facilities Review Committee meeting is open to the public but is not intended for public testimony. A copy of the pre-application conference notes, neighborhood meeting information, and all other documents and evidence submitted by or on behalf of the applicant, and applicable review criteria, are available for inspection at the Beaverton Planning Division, 4th floor, Beaverton Building, 12725 SW Millikan Way, between the hours of 8:30a.m. and 4:30p.m. Monday through Thursday except holidays. A copy of the staff report will be available for inspection at no cost at least seven (7) calendar days before the hearing. A copy of any or all materials will be provided at reasonable cost. Failure to raise an issue in a hearing, by testifying in person or by letter, or failure to provide statements or evidence with sufficient specificity to afford the decision-making authority an opportunity to respond to such issue, precludes appeal to the Land Use Board of Appeals on the issue.
