TRUSTEE’S NOTICE OF SALE Poe Loe and Kaw Shwe, as Grantors, made, executed, and delivered to Fidelity National Title Company of Oregon, as Trustee (Sherman, Sherman, Johnnie and Hoyt, LLP is now the duly appointed Successor Trustee), in favor of Habitat for Humanity Portland/Metro East, as Beneficiary, that certain trust deed dated August 25, 2014, and recorded on August 29, 2014 as Instrument No. 2014-086513, in the Official Records Multnomah County, Oregon (the Trust Deed), covering the following described real property commonly known as 2133 SE 171st Ave, Portland, OR 97233 and situated in said County and State: Unit 20, MADRIGAL CONDOMINIUM SUPPLEMENTAL PLAT NO. 4: ANNEXATION OF STAGE 5, in the City of Portland, County of Multnomah and State of Oregon, according to the official plat thereof Recorded August 20, 2014, Recording No. 2014-082101; Together with an undivided interest in and to the common elements appertaining to said unit as set forth in the Declaration of Unit Ownership made pursuant to the Oregon Condominium Act, recorded January 10, 2013, Recorders Fee No. 2013-005240, and First Supplemental Declaration recorded May 6, 2013, Recorder’s Fee No. 2013-061830, and Second Supplemental Declaration recorded December 31, 2013, Recorder’s Fee No. 2013-166983, and Third Supplemental Declaration recorded February 28, 2014, Recorder’s Fee No. 2014-018672 and Fourth Supplemental Declaration recorded August 20, 2014, Recorder’s Fee No. 2014-082102, and any/all amendments and further supplemental declarations thereto. The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is failure to pay when due the monthly installments according to the terms of the promissory note, secured by the first Trust Deed described below, namely: $37,951.56, 36 monthly payments in the amount of $1,054.21 each (due for February 2020 through January, 2023); $700.90, late fees; $420.00, NSF charges; ($782.47), less suspense balance; $38,289.99, Total amount past due January 1, 2023. There is also a default by the Grantor or other person owing the obligations, the performance of which is secured by a First Deed of Trust to Beneficiary Habitat for Humanity Portland/Metro East, recorded in Multnomah County Records Instrument No. 2014-086512. This is a foreclosure of the Second Deed of Trust only (described in the first paragraph above). In order to cure the default on this Trust Deed, the First Deed of Trust must be brought current. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $34,067.00, (principal); $182.00 , (recording fees); $34,249.00, Balance due on Trust Deed as of January 1, 2023, plus the cost of foreclosure report, attorney’s fees, and trustee’s fees; together with any other sums due or that may become due under the Note or by reason of the default, this foreclosure and any further advances made by Beneficiary as allowed by the Note and Deed of Trust. Notice is hereby given that the undersigned will on Tuesday, May 16, 2023, at 11:00 o’clock a.m., Pacific Time, on the front steps of the Multnomah County Courthouse, 1200 SW 1st Ave, Portland, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a rea-sonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.
