INROADS FEDERAL CREDIT UNION v. JACOB SAMUEL STONER; JORDAN MACKENZIE STONER; ALL OCCUPANTS; and ALL UNKNOWN HEIRS, PERSONS OR PARTIES UNKNOWN CLAIMING AN INTEREST IN THE PROPERTY SUMMONS – CASE NO. 23CV02085 IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF COLUMBIA TO: ALL UNKNOWN HEIRS, PERSONS OR PARTIES UNKNOWN CLAIMING AN INTEREST IN THE PROPERTY (collectively, Defendant), the above-named defendant. You are hereby required to appear and defend the complaint filed against you in the above entitled action within thirty (30) days from the date of the first publication of this summons, and in case of your failure to appear and answer, plaintiff for want thereof will apply to the above entitled court for the relief prayed for in its complaint, to-wit: A. FIRST CLAIM FOR RELIEF: 1. For judgment for foreclosure and sale of the Property located at 71502 Pruitt Road, Rainier, OR 97048 and a declaration of amount owed and secured by plaintiff’s First Deed of Trust comprising of the unpaid principal balance of $149,588.55, plus accrued interest in the amount of $2,712.92 through January 1, 2023, plus late charges of $136.80, plus interest accruing thereafter at the contract rate of 3.625 percent per annum ($14.87 per diem), from January 2, 2023, until the date said judgment is entered; plus the title search cost of $573.00; together with any additional sums required to be paid by plaintiff during the pendency of this suit for the protection of the Property and the plaintiff’s interest therein; plus plaintiff’s reasonable attorney fees, costs, and disbursements incurred herein; plus interest on the total sum in paragraph A1 at the contract rate of 3.625 percent per annum from the date judgment is entered, until paid in full; 2. That plaintiff’s Deed of Trust, dated July 13, 2021, recorded July 15, 2021, as Recording No. 2021-008349, Records of Columbia County, Oregon, be declared a first lien upon the Property for the amount of the judgment prayed for herein; 3. For judgment and decree that plaintiff’s First Deed of Trust upon the Property be foreclosed, and that the title, claim, interest, or demand of defendants in said Property, and every part thereof, except their statutory rights of redemption, be foreclosed; 4. For judgment and decree that the Property, with all of its appurtenances, rights, privileges, and easements be sold on execution by the Sheriff for Columbia County, Oregon, after giving notice as required by law; that plaintiff may be and become a purchaser at said sale; that the Sheriff give the purchaser thereof a Certificate of Sale and, unless the Property is redeemed before the expiration of the redemption period, a deed; that said purchaser have immediate possession of the Property, and every part thereof; and that said purchaser be entitled to such remedies as are available at law to secure such position, including a writ of assistance, if defendants or any other parties or persons shall refuse to immediately surrender possession to the purchaser; and 5. That the proceeds of the sale be applied as follows: first, to pay the costs and expenses of said sale; second, to pay the judgment of plaintiff due under paragraphs A1 and B1; and third, the surplus, if any, be paid to the Registry of the Court subject to further court order. B. SECOND CLAIM FOR RELIEF: 1. For judgment and a declaration of amount owed and secured by the Second Deed of Trust, declared to be the second position lien, comprising of the unpaid principal balance of $38,980.95, plus accrued interest of $1,095.36 through January 1, 2023, plus late charges of $55.60, plus interest accruing thereafter at the contract rate of 5.625 percent per annum ($6.02 per diem), from January 2, 2023, until the date said judgment and declaration of amount due is entered; together with any additional sums required to be paid by plaintiff during the pendency of this suit for the protection of the Property and plaintiff’s interest therein; plus plaintiff’s reasonable attorney fees; plus plaintiff’s costs and disbursements incurred herein; plus interest on the total on the total sum in paragraph B1 at the contract rate of 5.625 percent per annum from the date judgment is entered, until paid in full; and 2. All other liens of any defendant be declared subject to and inferior to the Deed of Trust and Second Deed of Trust, and that Plaintiff is authorized to credit bid the total amounts of the First Claim and Second Claim, without advancing any cash, and only if the First Claim and Second Claims are fully satisfied, for any surplus to be paid to any other party entitled thereto.
