IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH Department of Probate No. 23PR00454 NOTICE TO RESPONDENT OF RIGHT TO OBJECT TO APPOINTMENT OF CONSERVATOR In the Matter of the Proposed Conservatorship of: EMILY LYNN PENDERGRASS, Respondent. TO: Emily Lynn Pendergrass 1590 SE Liberty Ave Gresham, OR 97080 Your mother, Paula Pendergrass-Sorensen, has asked a Judge to appoint Nicole Svoboda’s Fiduciary Services, LLC, which is a business that provides conservatorship services, to be Conservator and to have the power to make decisions for you. The Judge has been asked to give this business the authority to make the following decisions for you: Financial decisions, including decisions on paying your bills and decisions about how your money is spent. YOUR MONEY MAY BE USED IF THE JUDGE APPOINTS A CONSERVATOR FOR YOU. YOU MAY BE ASKED TO PAY FOR THE TIME AND EXPENSES OF THE CONSERVATOR, THE TIME AND EXPENSES OF THE PETITIONER’S ATTORNEY, THE TIME AND EXPENSES OF YOUR ATTORNEY, FILING FEES, AND OTHER COSTS. YOU MUST TELL SOMEONE AT THE COURTHOUSE ON OR BEFORE MAY 17, 2023, IF YOU OPPOSE HAVING SOMEONE ELSE MAKE THESE DECISIONS FOR YOU. OBJECTIONS: You can write to the Judge if you do not want someone else making decisions for you. The Judge’s address is: Probate Court Judge Probate Department Multnomah County Circuit Court 1200 SW 1st Ave Portland, OR 97204 If you are not able to write to the Judge, but you want to object by contacting the Judge, telephone the Court at 971-274-0605, and the Court will set a time when you will appear in front of the Judge to file a verbal objection, which the Court will put in writing. You have the right to object to the appointment of a Conservator by saying you want to continue to make your own decisions. If you do not want another person, agency, or business making decisions for you, you can object. If you do not want Paula Pendergrass-Sorensen to make these decisions for you, you can object. If you do not want your money to be used to pay for these expenses, you can object. THE HEARING: The Judge will hold a hearing if you do not want a Conservator, do not want this particular person to act as your Conservator, or do not want your money used this way. At the hearing, the Judge will listen to what you and others have to say about whether you need someone else to make decisions for you, who that person should be, and whether your money should be spent on these things. You can have your witnesses tell the judge why you do not need a Conservator, and you can bring in records and other information about why you think that you do not need a Conservator. You can ask your witnesses questions and other witnesses questions. LEGAL SERVICES: You can call a lawyer if you do not want someone else making decisions for you. If you do not have a lawyer, you can ask the Judge whether a lawyer can be appointed for you. There may be free or low-cost legal services or other relevant services in your local area that may be helpful to you in the conservatorship proceeding. In addition, a list of free or low cost legal services in Multnomah County and phone numbers you can call has been mailed to you. OBJECTION FORM: You can mark the blue sheet (Respondent’s Objections) that has been mailed to you if you do not want someone else to make your decisions for you. You can show the blue sheet to your attorney or you can mail it to the Judge. Your rights have been described above. A summary of these rights is as follows: 1. The right to be represented by an attorney. 2. The right to file a written or oral Objection. 3. The right to request a hearing. 4. The right to present any evidence and cross-examine witnesses at any hearing. 5. If the Court decides that someone will be placed in charge of any of your financial decisions (a fiduciary) or if you already have a fiduciary, you have the right to ask the Court at any time to limit the power of the fiduciary. 6. If the Court decides that someone will be placed in charge of any of your financial decisions (a fiduciary), or if you already have a fiduciary, you have the right to ask the Court to take that person off of the case.
