NOTICE OF RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAM HOUSING ACQUISITION/REHABILITATION PROGRAM Date of Publication: April 27, 2023 City of Hillsboro 150 E. Main St. Hillsboro, OR 97123 503.681.5209 On or after May 8, 2023, the City of Hillsboro will submit a request to the US Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Service Act of 1974 to undertake the following project: Tiered 1 Broad Review Program Title: City of Hillsboro Housing Acquisition and Rehabilitation Program Purpose: Provide housing acquisition and rehabilitation grants Location: Hillsboro City Limits Program Description: The City of Hillsboro Housing Acquisition and Rehabilitation program will offer grants of up to $100,000 for home acquisition and $10,000 for home rehabilitation to low- and moderate-income first-time homebuyers through Proud Ground’s Community Land-Trust Program and owners/renters through the Housing Rehabilitation program. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. The actual funding for the program is identified in the City’s Annual Action Plan. Level of Environmental Review Citation: 24 CFR Part 58.35 (a)(5) – Residential Acquisition and 24 CFR Part 58.35 (a)(3) – Housing Rehabilitation Tier 2 Site Specific Review: The site specific review will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance – Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994, 42 USC 4001-4128 and 42 USC 5154a; Contamination and Toxic Substances – 24 CFR Part 50.3(i) & 58.5 (i)(2); Historic Preservation – National Historic Preservation Act of 1966, particularly sections 106 and 110, 36 CFR Part 800. Estimated Project Cost: $2,875,000 The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.35 (a)(5) and (a)(3)(i). An Environmental Review Record (ERR) that documents the environmental determination for this project is on file at 150 E. Main Street, 5th Floor, Hillsboro, OR 97123 and may be examined or copied weekdays from 8AM to 5PM. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Hillsboro. All comments received by May 8, 2023, will be considered by the City of Hillsboro prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City of Hillsboro certifies to the HUD that Robby Hammond, Certifying Officer, in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The HUD approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Hillsboro to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS The US Department of Housing and Urban Development will accept objections to its release of funds and the City of Hillsboro’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Hillsboro; (b) the City of Hillsboro has omitted a step or failed to make a decision or funding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred cost or undertake activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to US Department of Housing and Urban Development at Edith Green-Wendell Wyatt Federal Building 1220 SW 3rd Ave., Suite 400, Portland, OR 97204-2825.
