NOTICE OF PUBLIC HEARING BEFORE THE CITY COUNCIL (Legislative – LOC 50.07.003.16.e) Hearing Date, Time, and Location: The Lake Oswego City Council will hold a public hearing on Tuesday, May 16, 2023, at 3:00 p.m. This meeting will be conducted in-person at City Hall and an option for participating remotely via Zoom is also available. Applicant: City of Lake Oswego File Number: LU 22-0031 (Ordinance 2908) Nature of Application and Proposed Legislative Amendments: The City of Lake Oswego proposes to amend the Community Development Code to establish a new process to require mitigation for ministerial development through the provision of public improvements to offset the impacts of the development on public infrastructure. These amendments were prepared as a follow-up to the City Council’s recent adoption of middle housing amendments to the Community Development Code (development code, or CDC) to comply with House Bill 2001 (HB 2001), and to comply with the clear and objective standards for housing in ORS 197.307(4). The proposed amendments include: On October 10, 2022, the Planning Commission made a tentative recommendation that the City Council approve the proposed amendments. On Monday, April 24, 2023, the Commission made their final decision on the recommendation. Final Recommendation Delayed: At the direction of the City Council, the Commission’s final recommendation was delayed and staff was asked to gather information regarding whether public improvement requirements serve as a barrier to middle housing development, and to better inform decision-making related to the proposed amendments. Staff conducted several interviews with professionals in the building and real-estate development industry and produced an analysis of cost estimates from real-world project examples in Lake Oswego in order to provide more context on this issue. On March 21, 2023, the Council held a study session, received an update from staff, and directed staff to move forward with the proposed amendments.
