NOTICE OF PUBLIC HEARINGS FOREST GROVE PLANNING COMMISSION FOREST GROVE CITY COUNCIL FOREST GROVE DEVELOPMENT CODE AMENDMENTS FILE NUMBER 311-23-000006-PLNG NOTICE IS HEREBY GIVEN that the Forest Grove Planning Commission will hold a Public Hearing on Monday, May 1, 2023, and the Forest Grove City Council will hold public hearings on Monday, May 8, 2023, and Monday, May 22, 2023, at 7:00 p.m. or thereafter, at the Community Auditorium, 1915 Main Street and via Zoom video conferencing, to consider Development Code Amendments. The proposed Development Code amendments affect the following Code sections: –Article 1 Introduction and Procedures to update the lists of application types, increase approval time limits, and revise the Type 1 Process standards and procedures –Article 2 Land Use Reviews to clarify procedures for Type I site development reviews and Director’s Interpretations and add a land use review for Unlisted Use Authorization –Article 3 Zoning Districts to revise references to cannabis –Article 5 Special Provisions to require root barriers with street tree plantings –Article 6 Land Divisions to provide documentation of recorded final plats –Article 7 Miscellaneous Provisions to revise standards for residential accessory structures, home occupations, and manufactured homes on lots –Article 8 General Development Standards to revise access and circulation standards and building design and development standards –Article 12 Use Categories and Definitions to revise definitions for household living and home occupations, adopt a definition for facades & psilocybin, and remove references to the land use review process for Unlisted Use Authorization The Planning Commission and City Council will consider these proposals and base its decision on the following review criteria. Comments in response to this proposal must address the criteria of Development Code 17.2.630 Text Amendments: A. The text amendment is consistent with the relevant goals and policies of the Forest Grove Comprehensive Plan. B. The text amendment is consistent with the relevant statewide and regional planning goals, program and rules. All persons will be given reasonable opportunity to give testimony about this proposal responding to the review criteria above. If an issue is not raised in the hearing (by person or by letter) or if the issue is not explained in sufficient detail to allow the Planning Commission or City Council to respond to the issue, then that issue cannot be used for an appeal to the Land Use Board of Appeals. If additional documents or evidence are provided in support of the application, any party shall be entitled to a continuance of the hearing. Unless there is a continuance, if a participant so requests before the conclusion of the initial evidentiary hearing, the record shall remain open for at least seven days after the hearing.
