TRUSTEE’S NOTICE OF SALE Sergiy Logvynenko and Yelena Logvynenko, as Grantor, made, executed, and delivered to, Ticor Title, as Trustee (Sherman, Sherman, Johnnie and Hoyt, LLP is now the duly appointed Successor Trustee), in favor of Habitat for Humanity of the Mid-Willamette Valley, as Beneficiary, that certain trust deed dated December 14, 2015, and recorded on December 16, 2015, as Reel 3767, Page 343, in the Official Records of Marion County, Oregon (the Trust Deed), covering the following described real property commonly known as 925 Fuller Lane SE, Salem, OR 97306 and situated in said County and State: Lot 13, SAMARITAN LANE P.U.D., in the City of Salem, Marion County, Oregon. (Recorded October 13, 2008 in Volume H46, Page 104, Book of Town Plats). The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is failure to pay when due the monthly installments according to the terms of the promissory note, secured by the first Trust Deed described below, which is a default under the second trust deed, namely: $10,162.56, 12 monthly payments in the amount of $846.88 each (due for March 2023 through February 2024); $10,162.56, Total amount past due February 1, 2024. There is a default by the Grantor or other person owing the obligations, the performance of which is secured by a First Deed of Trust to Beneficiary Habitat for Humanity of the Mid-Willamette Valley, recorded in Marion County Records Book 3767, Page 342. This is a foreclosure of the Second Deed of Trust only. In order to cure the default on this Trust Deed, the First Deed of Trust must be brought current. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $41,603.41, (principal); $268.00, (foreclosure guaranty); $41,871.41, Balance due on Trust Deed as of February 1, 2024, plus the cost of foreclosure report, attorney’s fees, and trustee’s fees; together with any other sums due or that may become due under the Note or by reason of the default, this foreclosure and any further advances made by Beneficiary as allowed by the Note and Deed of Trust. Notice is hereby given that the undersigned will on Tuesday, June 11, 2024, at 10:00 o’clock a.m., Pacific Time, on the front steps of the Marion County Courthouse, 100 High Street SE, Salem, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic.
