The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is failure to pay when due the monthly installments according to the terms of promissory note, secured by the Trust Deed described above, namely: $15,412.20, 6 monthly payments in the amount of $2,568.70 each (due for September 2023 through February 2024); %514.06, late fees; $2,163.64, forced place insurance; $18,089.90, Total amount past due February 1, 2024. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $341,523.24, (principal); $9,069.87, (interest to February 1, 2024); $513.76, (late fees); $2,163.64, (forced place insurance); $1,030.00, (foreclosure guaranty); $354,300.51, Balance due on Trust Deed as of February 1, 2024, interest accrues thereafter at the rate of 5.35% per annum ($50.291 diem) on the principal amount, until paid in full. Notice is hereby given that the undersigned will on Tuesday, July 9, 2024, at 10:00 o’clock a.m., Pacific Time, on the front steps of the Washington County Courthouse, 145 NE 2nd Avenue, Hillsboro, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. In addition, stock in the amount of $1,000 must be repurchased in AgWest Farm Credit, ACA, successor by merger to Northwest Farm Credit Services, ACA pursuant to 12 USC 2034 as a condition of cure and reinstatement. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic.
