CITY OF HILLSBORO NOTICE OF PUBLIC HEARINGS CASE FILE NOS. AN-008-22 & ZC-009-22 SOHI COMMUNITY PARK

NOTICE IS HEREBY GIVEN that Two public hearings will be held before the City Council at or shortly after 7:00 pm, at their regular meeting on Tuesday, January 3, 2023. This meeting will be held in person in Conference Room 113 located on the 1st floor at the Civic Center, 150 E Main Street, Hillsboro, AND remotely via Zoom. The City Council will consider a request for annexation of two tax lots totaling approximately 55 acres in size into the City limits of Hillsboro and a City-initiated Zone Change on the subject site upon annexation. The purpose of the annexation is to facilitate future development of a community park and fire station. Also included would be the annexation of these tax lots into the Clean Water Services District and withdrawal from the Tualatin Valley Fire and Rescue Service District. The Planning Commission initiated the Zone Change at their regular meeting on December 14, 2022, recommending the City Council apply the R-4.5 and R-7 Residential base zones with associated Significant Natural Resource Overlay (SNRO) and Regulatory Floodplain Overlay (RFO) upon annexation.

The subject properties are located at 5678 and 5924 SW 229th Avenue and can be specifically identified as Tax Lots 101 and 200 on Washington County Assessor’s Tax Map 1S2-15 and are generally located north of SW Rosedale Road, south of SE McInnis Street, east of SE Century Boulevard, and west of SE 7th Avenue (note there is a small strip of the property that is west of SE Century Boulevard). The property owner and applicant is the City of Hillsboro Parks and Recreation Department, represented by Melissa Slotemaker, AKS Engineering and Forestry.

The applicable criteria for an Annexation are listed in Metro Code Chapters 3.09.045 and 3.09.050 and Section 12.80.010 of the CDC. The applicable criteria for a Zone Change are listed in CDC Section 12.80.160. The CDC may be viewed online at www.hillsboro-oregon.gov/communitydevelopmentcode or in the Planning Division office.

Prior to being posted on the City’s website, the City Council staff report for the Annexation will be available after 4:00 pm on Monday, December 19, 2022 and the staff report for the Zone Change will be available after 4:00 pm on Tuesday, December 27, 2022. ORS 197.797 provides that under certain circumstances, the record may remain open, or a continuance may be granted upon the request of a participant. If you are unable to attend the hearing, you may submit a written statement to the Planning Director at the address shown on the first page of this notice, on or before the hearing date. Telephone conversations cannot be accepted as testimony. Please reference the Case File No. on all written testimony.

Pursuant to Oregon Revised Statues (ORS) 197.797, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
