NOTICE OF BALLOT TITLE

BALLOT MEASURE TO ANNEX APPROXIMATELY 1.03 ACRES TO THE CITY OF BANKS

NOTICE IS HEREBY GIVEN that the City of Banks received a property owner request to annex approximately 1.03 acres of land that is contiguous to the current city boundary, that the city council reviewed the request, and recommended approval of the annexation proposal.

NOTICE IS FURTHER GIVEN that the Banks City Recorder has determined that the proposal contains only one subject, as required by section 1(2)(d), Article IV of the Oregon Constitution.

NOTICE IS FURTHER GIVEN that the Banks City Attorney has submitted the following ballot title for the proposal:

 

BALLOT TITLE

CAPTION:  Annexation of 1.03 acres to the City of Banks

QUESTION:  Shall the City of Banks annex 1.03 acres of contiguous land?

SUMMARY:  Annexation request initiated by the Banks city council on behalf of the owners of approximately 21 affected parcels, comprising 1.03 acres adjacent to the city’s current boundary, was reviewed and approved by the city council and now requires voter approval to become final.  Most of these parcels are already within the Banks city limits, but the western-most 30 feet on the back of each parcel was left out of the city when these lots were annexed.  This annexation will bring the remaining westerly 30 feet of these lots into the city limits, eliminate these islands of unincorporated Washington County land, and result in a more logical and appropriate city boundary.  City charter requires voter approval before this annexation can become final.

Any person who wishes to contest the ballot title or explanatory statement as written must file a petition for review of the ballot title in Circuit Court for Washington County as provided in ORS 250.296 not later than the seventh (7th) business day following the date the city received the ballot title, which is the date of this Notice stated below.
